NOTICE
Conclusion
of the Political Party
Concerning
raising the bar of quality and effectiveness in the execution of the political
trials in the face of new development.
In the meeting of August
16, 2007, after hearing the report of the law enforcement agencies regarding
the situation and results of the disposition of the recent political trials,
the Central Committee has discussed and has come up with the following
assessment:
Recently,
the disposition of these political trials have achieved some degree of success,
with the intent to make example of or to teach a lesson, to effectively prevent
the contrarian political activities of the enemy forces while they are still in
the embryonic stages, not allowing them from publicly establishing themselves
in the country to organize violent insurrection, in order to overthrow the rule
of the people. So we need to fortify the security measures for our political
stability and peaceful order in society, to protect the rule of
socialism, to resolutely contribute to the economic and societal development,
to build a political system and promote the strength of the whole solidarity
bloc of our nation populace, to ensure the perpetuation and stability of
socialism. Our teams of cadres and soldiers who specialize in the ad-hoc task
forces have made efforts in the execution of the political trials and to show
steadfast loyalty to the Fatherland, to uphold their political integrity,
possessing a high sense of duty, completing their responsibility and assignment
given to them.
However,
the quality and effectiveness of the execution of the political cases have not
met the requirements to enable the struggle to prevent and deal with these
crimes. The selection of the timeframes, the charges and rulings in a number of
cases have not been appropriate, lacking the experience in dealing with the
unexpected situations, creating complicated adjudication, allowing the accused excessive
responses, giving the opportunity for the enemy forces to use them as
propaganda, accusing our Party and our State of violating democracy and human
rights, freedom of religions…

The limitations cited above have many causes, first and foremost they
have arisen from the following subjective causes:

The coordination between law enforcement agencies at the local and central
levels when carrying out the prosecution was still limited, as the prosecution
and adjudication process of many political trials have taken place in such a
short and concentrated time, the preparation tasks were not thorough which led
to ruling that were not up to par.

The tasks of communication and propaganda have been untimely, lacking in
shrewdness. They have not been focused on the dangerous principal leaders of
the pack, those who have irresolutely fought us and violated the law numerous
times; people in charge have not satisfied the responsibility of fighting
against the criminals and to deal with external threats. The task of managing
the activities of the non-governmental agencies have not been tightened, the
redress of grievances and handling of complaints from the citizens have not
been satisfactory, creating disaffection in the populace.
In the near term, the
reactionary anti-state activities of the enemy forces from both inside and
outside the country will continue unabated and resolute. They will conspire
with ruses and innovative and refined methods, armed with insidious intentions
in order to successfully organize loyal opposition parties inside the country
to provide support for their radical and extremist counterparts to
utilize international forums on democracy and human rights, religions and
races to strengthen their reputation, slander and make false accusation
against the state in our national policy regarding the great solidarity of our
people; they will increase domestic infiltration activities, conducting
espionage inside
various
central and local agencies. They will utilize IT (information and technology)
and telecommunication in their intention to seek the destruction of
socialism. Therefore, to fight and defeat the attack plot of the enemy forces
is our first line of defense, urgent and immediate. Long-term, difficult and complex
tasks still lie ahead requiring the effort of the whole Party and the
people, where we cannot be vague, drop our guard or leaning to the right in
this effort.
To raise
our standard and the effectiveness of the execution in these political cases in
the face of a changing time, The Central Committee requests that the upper
cadres, Party structures and high level of government to focus and
implement successfully the following responsibilities:
1.
To increase the leadership role, unify and concentrate deeply and concretely in
order to spearhead and mobilize the total power of our complete political
system, where the whole society will participate in the struggle to fight and
prevent the crimes of violating our national security. The law enforcement
agencies have to rely on the people to discover the schemes and conspiracies
trying to undermine and destroy the ways and policies of the Party and the
State and the Great National Solidarity of the People. The administrative
execution of the arrests, prosecution and trials of these reactionary and
opportunist elements is necessary but it needs to be weighed carefully on many
fronts; to apply uniformly various fighting measures such as political,
rhetorical, argumentative and professional, at once firm, responsive and
intelligent: to disrobe the plot and nature of the enemy forces, to isolate the
recalcitrant leaders, to wrest and gain sympathy from people who are being
pulled by the other side, to limit the spread of false ideas in the population
about democracy, human rights, religious freedom, which impacts negatively on
the Party and the State foreign policy. To institute effort to neutralize
these organizations and individuals who conspire to maneuver against the
country and socialism.

To continue to study, master and organize effectively the directives,
resolutions of the Party regarding these tasks, such Directive 05-CT/TW of
October 14, 2006 from the Political Department concerning the strengthening of
leadership role in guarding national security in the new world order; Directive
12-CT/TW of May 3, 2007 of the Political Department concerning the Party
leadership vis-à-vis the law enforcement agencies in the projects of
investigation, execution of the political trials and the duty to protect the
Party…

To raise the standard of operation and to extol the responsibility of the law
enforcement agencies.
In the
basis of summation and evaluation of the tasks of execution of the recent
political trials, law enforcement agencies need to draw a good lesson from the
experience in order to promote as well as to point out the inadequacies,
mistakes in each case, each department in the prosecuting operation so as we
can overcome them. On the basis of implementing the correct ability, responsibility
and power of each respective agency, we need to strengthen the close
coordination in order to satisfy the quality, effectiveness of the execution of
the political cases. We need to tightly control the reactionary elements,
political opportunists who are anti socialism, we need to absolutely disallow
the establishment of the loyal opposition parties to maneuver violent overthrow
of the government.
To prepare
thoroughly and to place cadres who possess sufficient political knowledge and
intellect with experience and ability to conduct investigation, prosecution
tasks, and adjudicate political trials. The Central Police Ministry, The Party
Technocrats Committee, The Supreme People Procures, the Supreme People Court
need to make frequent reports to the General Secretary regarding the
situation and methods of execution, the results of our fights in regard to each
political case.
4.
To increase the foreign policy activities and to address the overseas people,
create a consensus, to compete for agreement and support of the progressive
elements who are initiating the fight on international and regional forums to
counter the libelous arguments, calumniating the Party, the State; to clarify
the plot and nature of the hostile elements in and outside of the country, not
allowing them to instigate protest, creating violent insurrections, and
division among the people and different institutions in the political system.
5.
To increase the public communication agencies roles in propagating and promoting
the achievements in economics, social; to build political system, security,
national defense and foreign activities, propaganda; to educate the people
about the law in order to increase their awareness about the policies of the
government and the State. At the same time we need to have plan to initiate an
effective and shrewd struggle in time to counter the false information, lacking
in objectivity about of the government policies regarding the people and

The provincial and municipal committees, the Party committees, technocrat
committees, party associations, party committees under direct central rule all
have based their decisions on this conclusion, according to their ranks,
responsibility of each unit, developed a plan to pursue and implement. To
delegate to the Party Central Office the task of monitoring the implementation
process, and making frequent reports to the Political Party, and
Secretary General.
